Marc is a devoted student and practitioner of negotiation and behavioral economic theory. Because the vast majority of cases settle before trial, Marc is committed to the idea that the mediation process deserves to be treated with the energy and vigor often reserved for litigation. To that end, Marc went in search of a more evolved mediation method. He found that method at the highly regarded Program on Negotiation at Harvard Law School where he completed basic and advanced negotiation and mediation training.

Marc is a registered mediator who helps clients and adversaries resolve disputes without the expense and delay of engaging in punishing legal conflicts. Marc is often called upon to consult on mediation strategy and preparation, to help negotiate and rescue beleaguered business transactions, and acted as the in-house negotiation trainer at his former law firm.

People participate in settlement negotiations because their negotiation counterparts (i.e., the other side) have something that they want. Obstacles to reaching an agreed-upon resolution can be many: The lack of inquiring into and understanding interests and emotions, failing to mutually identify key issues, a lack of justification for offers and demands, and others can doom negotiations if not properly understood and integrated into the mediation process itself.

We take a different approach to mediation. Ours is a multi-phase method that is designed, from beginning to end, to apply the key elements and strategies of successful negotiations. Inquiry and preparation start prior to mediation. Although we take mediation statements, preparation includes a more direct approach to gathering information from participants.
